1. Agreement to Terms

By accessing or using Mental Pushup (“the Service”), operated by Dryden Labs (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Mental Pushup is a personal life management platform that helps users track habits, set goals, monitor health metrics, and connect with accountability partners across four pillars: Faith, Family, Fitness, and Finance. The Service is available as a web application and may include free and paid subscription tiers.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account.

4. Free and Paid Plans

Mental Pushup offers a free tier with core features and a paid Pro tier with additional features. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. Fees are billed in advance on a monthly or annual basis depending on your chosen plan.

5. Founding Member Pricing

Founding Member pricing is available to a limited number of early subscribers. Once locked in, the Founding Member rate remains unchanged for the lifetime of your continuous subscription. If you cancel and later resubscribe, standard pricing will apply.

6. Refund Policy

We offer a 14-day money-back guarantee for all new paid subscriptions. If you are not satisfied with the Service within 14 days of your initial purchase, contact us for a full refund. After the 14-day period, payments are non-refundable. Cancellations take effect at the end of the current billing period.

7. Cancellation

You may cancel your subscription at any time through your account settings or the Stripe billing portal. Upon cancellation, you will retain access to paid features until the end of your current billing period. Your data is never deleted upon cancellation — it remains accessible if you choose to resubscribe.

8. User Content

You retain ownership of all content you create, upload, or store through the Service, including journal entries, photos, files, and personal data. We do not claim ownership of your content. You grant us a limited license to store and display your content solely for the purpose of providing the Service.

9. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the integrity or performance of the Service
Upload malicious code or content
Impersonate another person or misrepresent your affiliation
Use the Service to harass, abuse, or harm others

10. Third-Party Integrations

The Service may integrate with third-party services including Oura, Strava, Apple Health, Google Drive, and Stripe. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.

11. Account Guardian & Legacy

The Account Guardian feature allows you to designate trusted individuals who may request access to your account under specific circumstances. Guardian access requests are reviewed and require verification. We are not liable for any actions taken by designated guardians. Legacy capsule delivery is provided on a best-effort basis and depends on the availability of the Service.

12. Affiliate Program

Participation in our affiliate program is voluntary and subject to separate affiliate terms. Affiliate commissions are earned on qualifying paid referrals at the rate specified in your affiliate dashboard. We reserve the right to modify commission rates, approve or reject affiliates, and withhold commissions for fraudulent activity.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind. Mental Pushup is not a medical, financial, or professional advisory service. Any health, fitness, nutrition, or financial information provided is for informational purposes only and should not be considered professional advice.

14. Limitation of Liability

To the maximum extent permitted by law, Dryden Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
